Amendments to the List of Activities that have, or are likely to have, a Detrimental Effect on the Environment
This List (GN 921 of 2013) sets out which activities require a waste management licence. It was amended in 2014 and now once more.
Residue stockpiles and residue deposits were added to Categories A and B, which were amended as follows:
Category A
(15) The establishment or reclamation of a residue stockpile or residue deposit resulting from activities which require a prospecting right or mining permit, in terms of the Mineral and Petroleum Resources Development Act, 2002 (Act No. 28 of 2002).
Category B
(11) The establishment or reclamation of a residue stockpile or residue deposit resulting from activities which require a mining right, exploration right or production right in terms of the Mineral and Petroleum Resources Development Act, 2002 (Act No. 28 of 2002).
The amendments came into effect on 24 July 2015 with the simultaneous commencement of the Regulations regarding the Planning and Management of Residue Stockpiles and Residue Deposits.
