ENVIRONMENTAL, HEALTH AND SAFETY AND FOODSTUFFS LEGAL UPDATE REPORT (SOUTH AFRICA)                                                

JULY 2021

 

Dear Clients,

Below please find a summary of selected relevant environmental, health and safety and foodstuffs legal developments that took place during July 2021.

 

NATIONAL LEGISLATION

1)   Carbon Tax Act

  • Regulations on Carbon Offset

The Regulations were amended.

 

2)   Air Quality Act

  • Consultation on the Draft SA Atmospheric Emission Licence and Inventory Portal (SAAELIP) Data Management Policy

This draft policy was initially published on 2 July 2021 for public comment, and once more on 16 July 2021. It appears as if this was an error, alternatively that only minor corrections were made. Unfortunately, no explanation was provided as to why the draft policy was published twice. Its main aim appears to be to ensure that data which is stored or handled on the Portal is in line with legislation like the Promotion of Access to Information Act (PAIA) and the Protection of Personal Information Act (POPI).

 

3)   National Water Act

  • DRAFT Regulations for the Use of Water for Exploration and Production of Onshore naturally occurring Hydrocarbons that require Stimulation, including Hydraulic Fracturing and Underground Gasification, to Extract, and any activity incidental thereto that may impact detrimentally on the Water Resource

These draft Regulations were first published on 7 May 2021 for public comment. The commenting period was now extended for a further sixty days.

 

PROVINCIAL LEGISLATION

No relevant provincial legislation was published during this month.

 

MUNICIPAL LEGISLATION

4)    Mossel Bay Local Municipality

The new By-law relating to Refuse Removal was published. This repeals the 2010 by-law.

5)    Mopani District Municipality

The following new by-laws were published:

  • Emergency Services By-Laws (while not expressly stating so presumably they repeal the 2010 by-laws)
  • Water Services By-laws (these repeal the 2008 by-laws) (LAN 119 in PG 3182 of 9 July 2021).

6)    Victor Khanye Local Municipality

The following new by-laws were published:

  • Water Supply By-law
  • Wastewater By-law.
