Below please find a summary of selected relevant environmental, health and safety and foodstuffs legal developments that took place during July 2023.
NATIONAL LEGISLATION
No relevant national legislation was published this month.
PROVINCIAL LEGISLATION
No relevant provincial legislation was published this month.
MUNICIPAL LEGISLATION
1) Tswelopele Local Municipality
Standard Electricity Supply By-laws were published.
2) Laingsburg Local Municipality
The Watervoorsieningsverordeninge (Water Supply By-laws) were published. These were brought out in Afrikaans only.
They do not contain a repeal clause so it is unsure if, and to what extent, the 2013 By-law Relating to Water Supply, Sanitation Services and Industrial Effluent is still valid. In the event of a conflict between the two by-laws the new one will probably be applicable.
3) eThekwini Metropolitan Municipality
The following relevant new by-laws were promulgated.
- Municipal Public Health By-law (this also repeals the 1911 Public Health By-law)
- Food, Milk and Milk Products By-law (this in turn repeals the 1950 Food By-law and the 1950 Milk (and Milk Products) By-law).
They only take effect six months from the date of publication thereof in the Provincial Gazette (20 July 2023) or on such earlier date as may be determined by the publication of a commencement notice in the Provincial Gazette.
4) George Local Municipality
The new Air Quality Management By-law was promulgated. It repeals the 2010 Air Pollution Control By-law.
5) King Sabata Dalindyebo Local Municipality
The following new by-laws were promulgated:
- Abandoned, Dilapidated and Unsightly Building By-law
- Fences and Fencing By-law.
6) Buffalo City Metropolitan Municipality
The new Municipal Health Services By-law was published.
7) Great Kei Local Municipality
The following new by-laws were promulgated:
- By-law relating to the Prevention of Tampering with Electrical Installations and/or the Improper or Unauthorised Use of such Installations
- By-law relating to Solid Waste Disposal.
