Below please find a summary of selected relevant environmental, health and safety and foodstuffs legal developments that took place during November 2023.
NATIONAL LEGISLATION
1) Merchant Shipping Act
- Merchant Shipping (Training, Certification and Safe Manning) Regulations – Draft amendment
A notice was published of the Minister’s intention to amend the above Regulations.
2) Biodiversity Act
- Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES)
South Africa is a signatory to this Convention. Appendices I and II were amended.
3) National Water Act – Draft Amendment Bill
A draft amendment Bill was published for comment.
4) Water Services Act – Draft Amendment Bill
A draft amendment Bill was published for comment.
5) Draft Aquaculture Development Bill
A draft Bill was published for comment.
6) National Environmental Management Act
- Draft Solar Exclusion Norm and exclusion of the development and expansion of solar photovoltaic facilities from the requirement to obtain an environmental authorisation
This was published for public comment.
- Draft Battery Storage Exclusion Norm and exclusion of identified activities associated with the development and expansion of battery storage facilities from the requirement to obtain an environmental authorisation
This was published for public comment.
PROVINCIAL LEGISLATION
No relevant provincial legislation was published this month.
MUNICIPAL LEGISLATION
7) Ekurhuleni Metropolitan Municipality
The following new by-laws were promulgated:
- Electricity Supply By-law – this repeals the 2002 Electricity Supply By-law
- Water Services By-law – this repeals the 2002 Water Supply By-law.
8) Stellenbosch Local Municipality
The Municipality Zoning Scheme By-law was promulgated.
