Dear Clients,

Below please find a summary of selected relevant environmental, health and safety and foodstuffs legal developments that took place during 1 and 25 June 2025. It is sent slightly earlier as this practice will be closed until 14 July 2025.

 

NATIONAL LEGISLATION

ENVIRONMENTAL LEGISLATION

1) Waste Act

  • Industry Waste Tyre Management Plan, 2024

This plan was withdrawn by the Minister on 3 June 2025 with providing reasons. This means that the tyre industry will have to submit a new plan.

2) Water Services Act

  • Revised Compulsory National Water and Sanitation Services Standards

These new Standards replace the Regulations Relating to Compulsory National Standards and Measures to Conserve Water, GN R 509 of 8 June 2001. They are essentially aimed at water services authorities, water supply services and water services institutions.

3) National Ports Act

The Guidelines on the Proclamation to review, vary or extend the boundaries of an existing port or to determine the development of a new port were published.

 

HEALTH AND SAFETY LEGISLATION

4)  National Nuclear Regulator Act

  • National Nuclear Regulator Amendment Act, 2024

The amendments brought about by the 2024 Amendment Act entered into force on 4 June 2025. The Act is aimed at nuclear installations and not individual radioactive sources (such as those used in some factories).

5) Mine Health and Safety Act

The following Guidelines for a Mandatory Code of Practice were brought out:

  • Change Management in the South African Mining Industry
  • Prevention of Fires at Mines.

 

PROVINCIAL LEGISLATION

No relevant provincial legislation was published this month.

 

MUNICIPAL LEGISLATION

6) KwaDukuza Local Municipality

The following were published:

  • Spatial and Planning Land Use Management Amendment By-law
  • Business Licence By-law
  • Building Control By-law.

7) Drakenstein Local Municipality

The By-law Relating to the Installation of Telecommunications Infrastructure, 2025, was published.

8) Winnie Madikizela Mandela Local Municipality

The Air Quality Management By-law was published.

9) uMlalazi Local Municipality

The Nuisance By-law was published.

10) uMzimkhulu Local Municipality

The municipality published new Fire Fighting By-laws.

11) Cederberg Local Municipality

The Air Quality Management By-law was promulgated.

12) Mopani District Municipality

The following new by-laws were published:

  • Air Quality Management By-law
  • Waste Management By-law.
